Terms of Use

The short version

  • Mona is free, and yours to use on the Apple devices you own or control. There is nothing to buy and nothing to subscribe to.
  • Mona is not financial advice. It adds up the numbers you give it. The decisions stay yours.
  • Keep your own backups. Your data lives on your device and in your iCloud, so it is not something we can restore for you.
  • This agreement is with us, not with Apple. Apple distributes the app but is not a party to it.

Who you are agreeing with

Mona is made and published by Anh Nguyen ("we", "us"). These terms are an agreement between you and us, and they apply when you download or use the Mona app for iPhone and iPad. Using Mona means you accept them; if you do not, please delete the app.

Licence

We grant you a personal, non-transferable, non-exclusive licence to use Mona on any Apple-branded product that you own or control, as permitted by the Usage Rules in the App Store Terms of Service. Where those Usage Rules allow it, Family Sharing members may use the app too.

The licence covers use of the app. It does not transfer ownership of it: Mona, its name, its design and its code remain ours. You may not rent, lease, sell or sublicense the app, and you may not attempt to derive its source code except to the extent the law expressly permits despite this restriction.

What Mona is, and what it is not

Mona is a budgeting and expense-tracking tool. It arranges figures you enter, and figures it derives from them, and presents them back to you — including the "safe to spend" number, daily allowances, pacing and projections.

Those figures are estimates, not advice. Mona is not a bank, not a financial adviser, and not a regulated financial service. Nothing it shows is financial, investment, tax or legal advice, and it is not a substitute for advice from someone qualified to give it. Decisions about your money remain yours, and you are responsible for them.

Mona's output is only as good as what goes in. It does not connect to your bank, so it cannot know about anything you have not told it about. Recurring charges it detects are inferred from your own history and can be wrong. Check anything that matters against your actual account.

Your data and your backups

Your entries stay on your device and, if you use iCloud, in your own iCloud account. We do not hold a copy, which is deliberate — and it means we cannot recover your data for you if a device is lost, a sync goes wrong, or the app is deleted.

Keeping your own backups is your responsibility. Mona can make encrypted backups and export everything as a spreadsheet; please use them. How we handle the small amount of diagnostic data that does leave your device is set out in the Privacy Policy.

Using Mona properly

Please do not:

  • use Mona for anything unlawful, or to break anyone else's rights;
  • interfere with the app's security, or try to get at parts of it you are not meant to reach;
  • copy, modify or distribute the app or its content, except as these terms or the law allow.

Support

We are solely responsible for providing any maintenance and support for Mona. Apple has no obligation whatsoever to furnish any maintenance and support services in respect of the app. Support questions are welcome at support@get-mona.app, and the FAQ answers the common ones.

Warranty

Mona is provided "as is" and "as available", without warranties of any kind except those that cannot lawfully be excluded. We do not warrant that it will be uninterrupted or error-free, or that its figures will be accurate or suit your circumstances.

We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you — Mona is free, so that price is nothing. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our responsibility.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here limits your statutory consumer rights.

Claims about the app

We, not Apple, are responsible for addressing any claims by you or any third party relating to Mona or your possession and use of it, including but not limited to product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.

Intellectual property

In the event of any third-party claim that Mona or your possession and use of it infringes that third party's intellectual property rights, we — not Apple — will be solely responsible for the investigation, defence, settlement and discharge of that claim.

Where you may use Mona

By using Mona you represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Other people's terms

You must comply with any applicable third-party terms of agreement when using Mona — your wireless data plan, for instance, and Apple's own terms for the App Store and iCloud.

Apple's position

You acknowledge that this agreement is between you and us only, and not with Apple, and that Apple is not responsible for Mona or its content. Apple has no obligation to furnish any maintenance or support services for it.

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these terms, and that upon your acceptance of them Apple will have the right — and will be deemed to have accepted the right — to enforce these terms against you as a third-party beneficiary of them.

Limits on liability

To the extent permitted by law, we will not be liable for indirect or consequential loss, for loss of profit or opportunity, or for loss or corruption of data, arising from your use of Mona.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded or limited.

Changes

We may update these terms as the app changes. When we do, the date at the top changes with it, and continuing to use Mona means the updated terms apply. We may also change or discontinue features, and Mona may stop supporting older versions of iOS.

Governing law

These terms are governed by the laws of Vietnam. If you are a consumer, you keep the benefit of any mandatory protections of the law of the country where you live, and nothing here deprives you of the right to bring proceedings there.
